Terms and conditions

These terms and conditions apply to the use of the app and website Bromwijzer (hereinafter: "the app"), offered by [operator name: fill in via the admin portal] (hereinafter: "we"). By creating an account or using the app you agree to these terms. If you do not agree, do not use the app.

1. What the app does

The app plans routes for mopeds and light mopeds in the Netherlands, Belgium and Luxembourg, gives spoken navigation, shows fixed speed cameras and checks reported by users, and offers a community in which users share routes and post messages. The app is an aid; also read the disclaimer at https://app.bromwijzer.nl/en/disclaimer.

2. Account

• You need an account to use the app. You choose your own username and password; an e-mail address is not required.
• You are at least 16 years old. If you are younger, you may only use the app with the consent of a parent or guardian.
• You keep your password secret and are responsible for what happens with your account. If you suspect misuse, change your password or contact us.
• You have one account per person and do not create an account for someone else.
• You can delete your account yourself at any time via Profile → Account → Delete account, or via https://app.bromwijzer.nl/en/account-verwijderen.

3. Responsible use in traffic

• The route and the spoken instructions are advice. Traffic signs, traffic rules and instructions from the police always take precedence.
• As the rider you are responsible for your riding behaviour, for choosing where you ride (roadway or cycle/moped path) and for complying with the law.
• Do not operate the app while riding. Set your route before you leave and stop in a safe place if you want to change something.
• Only use the app with a vehicle that meets the legal requirements and with a valid licence where required.

4. Reports, routes and community content

You can post content in the app: reports of speed cameras and checks, photos, shared routes, reviews, forum posts, comments and your public profile (hereinafter: "content").

• You only post content that is correct and that you are allowed to share. You make reports in good faith and only for situations you have observed yourself.
• Not allowed is content that is unlawful, misleading, threatening, offensive, discriminatory, sexual or violent; that infringes the rights of others (including privacy and copyright); that contains personal data of others, such as number plates, faces or names of officers; that is advertising or spam; or that endangers traffic or law enforcement.
• Reports are meant to alert riders to checks and dangerous spots, not to encourage offences. The reporting function may not be used to track people or to obstruct police work.
• You grant us a free, worldwide, non-exclusive licence to display, store, edit (for example resize) and distribute your content in the app and on the website, for as long as the content is in the app. You remain the owner of your content.
• We do not check content in advance, but we may remove or hide content without consultation if it violates these terms or there is reason to do so. You can report content and users via the report button in the app; we assess reports and take action where necessary.
• In the case of serious or repeated violations we may suspend or delete your account.

5. Intellectual property and sources

• The app, its design, the software and the data we have compiled belong to us or our licensors. You may only use the app as intended; copying, decompiling, automated extraction or commercial exploitation is not allowed without our written consent.
• Map and road data: © OpenStreetMap contributors, available under the Open Database License (ODbL). Map display via OpenFreeMap. Routing with Valhalla. Precipitation data from Buienradar and Open-Meteo. Photos of places via Wikipedia and Wikimedia Commons (CC BY-SA, with attribution).
• The terms of the respective source apply to that data.

6. Availability and changes

• We do our best to keep the app available and up to date, but do not guarantee uninterrupted operation, error-free routes or current data. Maintenance, outages, an empty battery, no coverage or an error in the map data may limit use.
• We may change the app at any time, add or remove features, or discontinue the app. In the event of a substantive change to these terms we will ask for your agreement again in the app.
• The app is currently free. If we start offering paid features, you will hear about it in advance and additional terms will apply.

7. Liability

• The app is an aid. We are not liable for damage resulting from the use of the app or from its unavailability, including traffic fines, accidents, damage to your vehicle or phone, detours or missing an appointment, unless the damage is the result of intent or deliberate recklessness on our part.
• Insofar as we are nevertheless liable, that liability is limited to direct damage and to the amount you paid for the app in the twelve months before the damage.
• These limitations do not apply insofar as the law prohibits them, for example under mandatory consumer law.
• You indemnify us against claims from others arising from content you have posted or from your use of the app in violation of these terms.

8. Privacy

How we handle your data is set out in the privacy statement at https://app.bromwijzer.nl/en/privacy. It forms part of these terms.

9. Termination

• You can stop using the app and delete your account at any time (article 2).
• We may terminate your access in the event of a violation of these terms or if we discontinue the app. Where possible we will let you know in advance.
• Content you have posted is deleted when your account is deleted, as described in the privacy statement.

10. Applicable law and complaints

• Dutch law applies to these terms. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise. If you are a consumer, you may also choose the court of your own place of residence within the EU.
